Terms of service
The agreement between you and Winkly: who can use it, the community rules and how accounts work.
Last updated October 25, 2026
Agreeing to these terms
These terms are an agreement between you and Lazykraft (“we”, “us”), which runs Winkly. By creating an account or using the Winkly app or website, you agree to them. If you don’t agree, don’t use Winkly.
Our Privacy policy explains how we handle your information, and our Child safety standards are part of these terms.
Who can use Winkly
To use Winkly, you must:
- be at least 18 years old;
- be able to enter a binding contract where you live;
- not have been convicted of, or be required to register for, a sex offence or any violent crime;
- not have been banned from Winkly before, and not be barred from using it under the law that applies to you.
Your account
- You sign in with your Google or Apple account and may have only one Winkly account.
- Keep the information on your profile true and up to date. Your photos must show you, and your name and age must be your own.
- You’re responsible for what happens on your account. Keep your device and sign-in account secure, and tell us at [email protected] if you think someone else is using it.
- Don’t sell, transfer or share your account.
Community rules
Winkly has zero tolerance for objectionable content and abusive behaviour. You must not:
- harass, bully, stalk, threaten or intimidate anyone;
- post or send nudity, sexually explicit material, or graphic violence, or send sexual content to anyone who hasn’t asked for it;
- post hate speech, or attack people for their race, ethnicity, nationality, religion, disability, gender, gender identity, sexual orientation or age;
- threaten, promote or glorify violence, self-harm or terrorism;
- share anything that sexualises or exploits children, in any way;
- pretend to be someone else, use other people’s photos, or create a fake profile;
- scam people, ask members for money, or promote or sell goods, services or sexual services;
- spam people or send unwanted promotional messages;
- share someone’s private information, or images of them, without their permission;
- use Winkly for anything illegal, or encourage anyone to break the law.
Your content
You own the photos, text, voice messages and other content you add to Winkly. You’re responsible for it, and you confirm that you have the right to share it and that it follows these terms.
You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, display and deliver that content so we can run Winkly: for example, to show your profile to other members and deliver your messages. The licence ends when the content is deleted from Winkly, except for messages that remain in another member’s chat and content kept for safety reasons, as described in our Privacy policy.
Content from other members belongs to them. Don’t copy, share or publish it outside Winkly without their permission.
Your safety
You’re responsible for your interactions with other members, online and in person. We don’t run criminal background checks or confirm the identity of members. A verified badge means our team matched a verification photo with the profile photos; it doesn’t confirm who someone is or how they’ll behave.
Take care when you meet someone new: get to know them on Winkly first, meet in a public place, tell a friend where you’re going, and never send money to someone you’ve met online. If you’re in danger, contact your local emergency services.
Reporting, blocking and moderation
You can block or report any member from their profile or your chat with them. Blocking someone ends your match and stops them from contacting you. Our team reviews every report.
If we believe someone has broken these terms, we may remove content, suspend their account for a period, or ban it permanently, with or without notice. We may also report illegal activity to the authorities. If you think we got a decision about your account wrong, email [email protected] and we’ll look at it again.
Paid features
Winkly is free to use. If we offer paid features or subscriptions, you’ll buy them through the App Store or Google Play, and that store’s payment terms also apply.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can cancel in your App Store or Google Play account settings. Deleting the app or your Winkly account doesn’t cancel a subscription.
- Refunds are handled by Apple or Google under their policies, unless the law where you live gives you other rights.
- We’ll show you the price before you buy. If a subscription price changes, we or the store will tell you before it applies to you.
Third-party services
Some features rely on services from other companies, such as signing in with Google or Apple, and searching for GIFs with GIPHY. Those companies’ own terms and privacy policies apply to how you use their services. We aren’t responsible for them.
Our rights in Winkly
Winkly, including its software, design, name and logo, belongs to Lazykraft. We give you a personal, non-transferable, revocable licence to use the app for its intended purpose, under these terms. You must not:
- copy, change, reverse engineer or try to get at the source code of Winkly;
- use bots, scrapers or other automated means to access Winkly or collect information about members;
- interfere with Winkly’s security, or overload or disrupt the service;
- use Winkly to build a competing product.
Ending your account
You can delete your account at any time in the app (see Delete your account). We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering Winkly. Sections of these terms that by their nature should continue after your account ends, such as the content licence for messages that remain in other members’ chats, disclaimers, limits on liability and dispute terms, continue to apply.
Disclaimers
Winkly is provided “as is” and “as available”. To the extent the law allows, we make no promises that the service will be uninterrupted, secure or error-free, or that you’ll find a match. We aren’t responsible for the conduct of any member, on or off Winkly, or for content that members post.
Limits on our liability
To the extent the law allows, Lazykraft isn’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Winkly or your dealings with other members. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.
Some places don’t allow these limits, so they may not all apply to you. Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or for fraud.
Indemnity
To the extent the law allows, you agree to cover our costs and losses if someone makes a claim against us because of content you posted, how you used Winkly, or your breaking these terms or the law.
Governing law and disputes
If you have a problem with Winkly, please contact us first at [email protected]. Most issues can be solved that way. If you live in a country whose consumer laws give you the right to bring a claim in your local courts or under your local law, you keep that right.
Apple App Store and Google Play
If you downloaded Winkly from the Apple App Store, you also agree that:
- these terms are between you and Lazykraft, not Apple, and Lazykraft, not Apple, is responsible for Winkly and its content;
- Apple has no obligation to provide maintenance or support for Winkly;
- if Winkly fails to meet any applicable warranty, you can tell Apple, and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation for Winkly;
- Lazykraft, not Apple, is responsible for any claims relating to Winkly, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims and claims that it infringes someone’s intellectual property;
- you aren’t located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and you aren’t on any US Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
If you downloaded Winkly from Google Play, Google’s terms for Google Play also apply, and Google isn’t responsible for Winkly.
Changes to these terms
We may update these terms. The date at the top shows when they last changed. If we make a significant change, we’ll tell you in the app before it takes effect. If you keep using Winkly after that, you accept the new terms; if you don’t, you can delete your account.
